THESE TERMS INCLUDE DISCLAIMERS OF WARRANTIES, LIMITATIONS OF LIABILITY, A DISPUTE RESOLUTION CLAUSE INCLUDING BINDING ARBITRATION, A CLASS ACTION WAIVER, AND A JURY TRIAL WAIVER — EACH TO THE MAXIMUM EXTENT PERMITTED BY LAW. These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any disputes shall be resolved in the state or federal courts located in Los Angeles County, California, unless subject to binding arbitration as outlined below.
You agree that any dispute arising from these Terms or your use of the Services shall be submitted first to informal negotiation and, if unresolved, to binding arbitration administered by the American Arbitration Association (AAA) in accordance with its rules.
TO THE EXTENT PERMITTED BY LAW, YOU AND DERMAGLOW EACH WAIVE ANY RIGHT TO A TRIAL BY JURY AND AGREE NOT TO PARTICIPATE IN ANY CLASS OR REPRESENTATIVE ACTION.
Any claim you may have must be brought within one (1) year from the date it arose. Failure to do so waives the claim permanently.
This Agreement is effective until terminated. You may terminate at any time by ceasing all use of the Site. We may terminate or suspend access immediately without notice for violations of these Terms.
We are not liable for failure to perform due to causes beyond our control, including but not limited to natural disasters, power outages, labor disputes, government actions, internet failures, or pandemics.
If any provision of these Terms is held unenforceable, the remainder remains valid. Our failure to enforce a right does not waive our ability to do so later.
We may modify these Terms at any time. Changes will be posted with a new “Effective Date.” Continued use after such date constitutes acceptance. We may notify users via email or banner alert where appropriate.
You can expect to receive SMS messages regarding your appointment (should you book one with DermaGlow Lab & Aesthetics), as well as an occasional SMS message alerting you to specials we are offering, that will include ways to get in touch or to book an appointment. You can cancel the SMS service at any time. Simply text “STOP” to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you. If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to admin@dermaglowla.com or 323-837-8028. Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies.
